1. Agreement to Terms

By accessing or using the HerMax mobile application (“the App”), you agree to be bound by these Terms of Service and Apple’s Standard Licensed Application End User License Agreement (EULA). These terms constitute a legally binding agreement between you and HerMax. If you do not agree to these terms, you must cease use of the App immediately.

2. Medical Disclaimer

HerMax provides AI-powered facial analysis and personalized self-improvement routines (including skincare and grooming recommendations) for informational, educational, and entertainment purposes only. The App is not a medical device and does not provide medical advice, professional diagnosis, or treatment.

The services provided are not intended to detect, diagnose, or monitor skin cancer, melanoma, or any other serious dermatological or health conditions.

Always seek the advice of a board-certified dermatologist or other qualified healthcare provider with any questions regarding a medical condition.

Never disregard professional medical advice or delay seeking it because of information generated by the App.

3. Privacy and Biometric Data

By utilizing the face-scanning features of the App, you grant HerMax the right to process your image data to perform facial analysis and generate your Glow-Up ratings and routine.

  • Data Usage: Image data is used solely to provide your ratings and personalized routine; images are not stored (see our Privacy Policy).
  • Protection: We do not sell biometric or facial data to third parties.
  • Eligibility: Users must be at least 13 years of age. By using the App, you represent that you meet this age requirement.

4. Fair Use Policy

To maintain the integrity and performance of our AI infrastructure, usage is subject to a fair use limit. Individual user accounts are limited to a maximum of 1,000 face scans per calendar month. HerMax reserves the right to suspend accounts that exceed this limit or exhibit behavior indicative of automated or abusive use.

5. Subscriptions and Payments

Access to certain premium features may require a paid subscription.

  • Billing: Payments will be charged to your Apple ID account at the confirmation of purchase.
  • Renewal: Subscriptions automatically renew unless they are canceled at least 24 hours before the end of the current billing period.
  • Management: You may manage or cancel your subscription at any time by accessing your Account Settings on the App Store.

6. Limitation of Liability

To the fullest extent permitted by applicable law, HerMax and its affiliates, officers, and employees shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the App, including but not limited to skin irritation, allergic reactions, or dissatisfaction with recommended products or routines.

7. User Conduct and Restrictions

You agree to use the App only for lawful purposes. You are prohibited from:

  • Attempting to reverse-engineer, decompile, or extract the source code of the AI analysis engine.
  • Using the App to upload or transmit any malicious code or viruses.
  • Misrepresenting your identity or providing false information for facial analysis.

8. Amendments

We reserve the right to modify these terms at any time. We will notify users of material changes by updating the "Last Updated" date at the top of this document. Continued use of the App following such changes constitutes your acceptance of the revised terms.
